Annual Reports & Personal Property Tax Returns

Important Information for Businesses: ​​

Starting in 2018, our Department will be updating the paperwork that all entities are required to file annually in order to legally operate in Maryland. "Form 1" will now be separated into an "Annual Report" and a "Personal Property Tax Return." If you own a business, scroll down for more information on these important changes that will impact you. Do I need to file both an Annual Report and a Personal Property Tax Return?​​​

All business entities formed, qualified, or registered to do business in Maryland must file an Annual Report every year. If the business can answer "Yes" to either of the following questions, they must also file a Personal Property Tax Return with their annual report:
  • ​Does the business own, lease, or use personal property located in Maryland?
  • Does the business maintain a trader's license with a local unit of government in Maryland?

All Annual Reports and Personal Property Tax Returns must be submitted by April 15 annually, unless you request an extension here. If you created your business on or after January 1, 2018, you are not required to file an Annual Report or Personal Property Tax Return until April 15, 2019.
 

Can I file my Annual Report and Personal Property Tax Return online using Maryland Business Express?​

Maryland Business Express is SDAT's award-winning platform for making annual filings, registering and establishing businesses, and requesting document copies online. It is the easiest way to file an Annual Report and Personal Property Tax Return for most businesses.
 
However, if you fall into one of the following categories, you will not be able to file your Annual Report and Personal Property Tax Return online. You will need to download and complete an Annual Report and/or Personal Property Tax Return, found below.
  • Government Entity;
  • General Partnership;
  • Credit Union, Financial Institution, Bank, Savings Bank, Savings & Loan, and Trust Companies;
  • Co-operative (non-stock);
  • Rental Property in Worcester County (unincorporated);
  • Public Utility; or
  • Cable Company.

If any of the following conditions apply to your business, you also will not be able to file your Annual Report and Personal Property Tax Return online.
  • Your business is not in good standing due to a status of dissolved, merged, or consolidated;
  • Your business has a status of forfeited; or
  • You owe past years' Annual Reports and Personal Property Tax Returns and you have never filed online before.

Filings for Sole Proprietorships & General Partnerships:​

Sole Proprietorships and General Partnerships are not required to file Annual Reports with our Department. They may be required to obtain an SDAT identification number and file Personal Property Tax Returns in order to comply with state and local licensing and taxation requirements. This includes Sole Proprietorships and General Partnerships that own, lease, rent, use, or borrow personal property or need a business license.

​Filings for Rental Units:

Owners of rental units such as Condominiums, Townhouses, Cottages, Rooms, etc., are not required to file Annual Reports with our Department. They may be required to obtain an SDAT identification number and file Personal Property Tax Returns in order to comply with state and local licensing and taxation requirements. 

​​Filings for Financial Institutions, Banks, and Credit Unions:

Financial Institutions; Banks, Savings Banks, Savings & Loans, and Trust Companies; and Domestic and Foreign Credit Unions must file an Annual Report and a Personal Property Tax Return. Due to the unique attributes of these types of entities, both of these filings are combined.
